Louisiana Prenuptial Agreement
This Prenuptial Agreement ("Agreement") is made and entered into on this ___ day of ____________, 20__, by and between ___________________ (hereinafter "Party One") and ___________________ (hereinafter "Party Two"), with both parties collectively referred to as "the Parties" and individually as "a Party".
WHEREAS, the Parties are planning to marry under the laws of the State of Louisiana; and
WHEREAS, the Parties wish to establish their respective rights and responsibilities regarding each individual's assets and liabilities, and the management of their financial matters during the marriage, in the event of separation, divorce, or death, in accordance with the Louisiana Matrimonial Regimes.
WHEREAS, both Parties have had sufficient time to review this Agreement, seek legal advice, and enter into this Agreement voluntarily.
NOW, THEREFORE, in consideration of the forthcoming marriage, and in consideration of the mutual promises and covenants contained herein, the Parties agree as follows:
1. Disclosure of Assets and Liabilities
Each Party has fully disclosed to the other their current financial status, including all assets and liabilities. Attached hereto as Exhibit A (for Party One) and Exhibit B (for Party Two) are the financial statements of each Party.
2. Separate Property
The Parties agree that the property listed in Exhibit A and Exhibit B, respectively, as well as any property acquired by a Party through inheritance, gift, or personal effort after marriage, shall remain the separate property of that Party.
3. Marital Property
Any property acquired by the Parties during the marriage through joint efforts shall be considered marital property and subject to division as agreed by the Parties or by the court, in the event of separation or divorce.
4. Spousal Support
Each Party's rights to seek spousal support from the other in the event of separation or divorce are hereby waived, except as otherwise agreed in writing after the execution of this Agreement or as required by law.
5. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Louisiana.
6. Amendment
This Agreement may only be amended or revoked by a written document signed by both Parties.
7. Enforcement
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be fully effective.
8. Entire Agreement
This document contains the entire agreement between the Parties and supersedes all prior negotiations, agreements, or understandings, if any.
