Louisiana Marital Separation Agreement Template
This Marital Separation Agreement (hereinafter referred to as the "Agreement") is made and entered into on this _____ day of ________________, 20____, by and between ______________________ (hereinafter referred to as "Spouse 1"), and ______________________ (hereinafter referred to as "Spouse 2"), both of whom agree to be bound by this Agreement. This Agreement establishes the parties' rights, obligations, and responsibilities to each other and to their children, if any, arising out of their marital relationship. Both parties have agreed to live separate and apart and wish to define the terms of their separation in accordance with the laws of the State of Louisiana.
WHEREAS, the parties were lawfully married on the _____ day of ________________, 20____, in the City of ______________________, State of Louisiana; and
WHEREAS, the parties have experienced irreconcilable differences, leading them to this separation; and
WHEREAS, they wish to formalize their separation and address matters concerning child custody, child support, spousal support, property division, and debt allocation without the need for court intervention, insofar as permitted by the laws of the State of Louisiana, particularly referencing the Louisiana Civil Code.
NOW, THEREFORE, in consideration of the mutual promises contained herein and for other valuable consideration received, and intending to be legally bound, the parties agree as follows:

- Amendments: Any amendment to this Agreement must be made in writing and signed by both parties. Verbal agreements will not be recognized or enforceable under this Agreement.
- Governing Law: This Agreement shall be governed by, and construed in accordance with, the laws of the State of Louisiana.
